Grid Connect Limited Warranty Statement

Limited Warranty for Products Manufactured by Grid Connect

Grid Connect warrants the original purchaser of hardware manufactured by Grid Connect that the hardware to be free from manufacturing defects for one (1) year from the date of purchase. Grid Connect’s liability under this warranty is limited to replacing or repairing, at its option, hardware that it determines has a manufacturing defect before the end of the warranty period that prevents the hardware from performing the functions it was manufactured to perform. The warranty for the repaired product only extends for the remainder of the original warranty period, or 30 (thirty) days, whichever is longer. This Limited Warranty extends only to the original purchaser of Grid Connect products. All others are not eligible to return products to Grid Connect for warranty consideration.

This warranty does not apply to semiconductor chips or consumables such as batteries and fuses.

 

Software Warranty

Grid Connect warrants to the original purchaser that for a period of sixty (60) days from the date of shipment of the product by Grid Connect, the media on which software is furnished will be free of defects in materials and workmanship under normal use and that the software reasonably contains the features described in the applicable product data sheet. Grid Connect’s liability under this warranty is limited to replacing or repairing, at its option, software or its media that Grid Connect determines breaches this warranty before the end of the warranty period in a way that prevents the software from performing its essential features.

 

Conditions That Are Not Defects

Grid Connect’s limited warranties do not and Grid Connect does not otherwise warrant that any product or service it sells will:

 

  • Meet a purchaser’s requirements or be fit for the purchaser’s intended use, even if Grid Connect is informed of the requirements or intended use before purchase.
  • Operate uninterrupted or error-free. For example, radio devices which are by nature subject to electrical noise, disruption, error inducing and disruptive phenomenon. Stated line-of-sight range and in-building ranges may not meet factory estimates of range. Estimates of range are subject to local conditions including atmospheric, multi-path fading and degradation due to reflections, attenuation, and noise and interference from other RF radiating sources. The operation of software may be affected by the processing unit running the software or by the electrical environment it operates in.
  • Interoperate with any other hardware, software or other system components claiming compatibility to the same specifications or the specifications are complete and comprehensive.
  • Comply with communications laws or other laws of every country. Due to variation in and the changes to laws, a product may be illegal for use in some countries. Grid Connect is not responsible for any fines or penalties incurred by a purchaser resulting from the use of a product purchased from Grid Connect.

 

Warranty Exclusions

Any of the following will void the limited warranties:

  • Mishandling, tampering with (internal or external), or improperly storing of the product.
  • Disassembling, dissecting or modifying the product.
  • Connecting the product improperly or to unauthorized or harmful inflows or outflows.
  • Changing the physical properties of the product.
  • Use of the product for other than its intended purpose or in a manner for which it was not designed.
  • Exposing the product to extreme temperatures, moisture, dampness, high humidity, damaging chemicals or vapors or harmful environmental conditions.
  • Exceeding the stated operational parameters, including but not limited to voltage, power, load and use restrictions.
  • Transporting the product outside of country in which it was purchased and delivered, or transporting or purchasing the product in violation of import or export restrictions.
  • Installing or using the product in a country in which it is not registered for use (if registration is required) or is illegal to use, or for which the product was not designed.
  • Installing or using the product in a manner inconsistent with the technical or safety standards or the standards in effect in the country for which the product is designed.
  • Removing, defacing, erasing, or altering any manufacturing or use information on the data plate or elsewhere, including but not limited to the serial number, date code, or internal program revision number.
  • Product receiving an electrical discharge from lightning, static electricity or power surge
  • Repairing the product without authorization from Grid Connect or not as instructed by Grid Connect after receiving authorization.
  • Failing to comply with Grid Connect’s instructions, use restrictions or warnings.

 

Breach of Warranty Remedy

The only remedy for a breach of a Grid Connect warranty is product repair or replacement. These warranties are in lieu of any other warranties, express, implied, or statutory, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement or the like, and any warranty otherwise arising out of any proposal, specifications, or sample, or the accompanying written materials.

 

IN NO EVENT SHALL GRID CONNECT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES FOR BREACH OF THIS OR ANY OTHER WARRANTY, EXPRESSED OR IMPLIED, WHATSOEVER, WITHOUT LIMITING THE FOREGOING, GRID CONNECT SHALL NOT BE LIABLE FOR LOSS OF PROFITS, LOSS OF DATA OR HARM TO PERSONS OR PROPERTY.

 

Warranties on Products Distributed by Grid Connect

For products exclusively resold by Grid Connect, where Grid Connect functions solely as the distributor rather than the manufacturer, Grid Connect does not make any explicit or implicit claims or warranties regarding their merchantability, fitness for specific purposes, or any other aspects related to these products.

Grid Connect is committed, however, to make every reasonable effort to support the purchaser in pursuing any warranties offered by the respective manufacturer(s) of such products. Please note that decisions concerning repairing or replacing faulty products under warranty rest entirely with the manufacturer.

 

How to Make a Warranty Claim

A warranty claim must be submitted by the original purchaser. To submit a warranty claim, instructions are provided in our Return Policy.

 

Liability Disclaimers

The limited warranties stated above for products manufactured by Grid Connect and for software are the only warranties provided by Grid Connect. Except for such warranties, all products and services sold by Grid Connect are sold AS IS and without any implied warranties of MERCHANTABILITY, fitness for a particular purpose, or non-infringement.

Other than the Grid Connect’s limited warranties, Grid Connect makes no representations or promises regarding the products or services it sells. Grid Connect is not liable for damages, including, but not limited to, loss of data or business information, lost profits, lost savings, lost business opportunities, business interruption or special, incidental, consequential, or exemplary damages, arising from the use or inability to use the product, even if Grid Connect was advised of the possibility of such damages. Grid Connect disclaims all liability for any affirmation, promise or representation concerning the products.

Grid Connect assumes no liability resulting from changes to government regulations affecting use of materials, equipment, safety, and methods of repair. Grid Connect’s entire liability and the exclusive remedy under the Limited Warranty in contract or tort or otherwise in any way connected with the product shall be limited to the replacement or repair of the product.

The foregoing limitation may be void in states or countries that prohibit the exclusion or limitation of liability for consequential or incidental damages.

Grid Connect’s products are not designed, manufactured, or intended for use or resale as online control equipment in hazardous environments requiring fail-safe performance, such as the operation of nuclear facilities, aircraft navigation, communication systems, air traffic control, life support machines, medical monitoring, medication delivery, weapons systems, remote control or any industry in which technology failure could lead to death, personal injury, severe physical or environmental damage or damage to property.

Customer acknowledges that except as expressly set forth or referenced above THERE ARE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, IN ADVERTISING MATERIALS, BROCHURES, OR OTHER DESCRIPTIVE LITERATURE) BY GRID CONNECT OR ANY OTHER PERSON, EXPRESS OR IMPLIED, AS TO THE CONDITION OR PERFORMANCE OF ANY PRODUCTS, THEIR MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE AND ANY SUCH WARRANTIES ARE SPECIFICALLY DISCLAIMED BY CUSTOMER.

 

Indemnification

The customer agrees to hold Grid Connect harmless from, defend, and indemnify Grid Connect against damages, claims, and expenses arising out of the subsequent sales of Grid Connect products or products containing components manufactured by Grid Connect, and based upon personal injuries, deaths, property damage, lost profits and other matters which Buyer, its employees, or subcontractors are or may be to any extent liable, including without limitation penalties imposed by the Consumer Products Safety Act (P.L. 92-573) and liability imposed upon any person under the Magnuson-moss Warranty Act (P.L. 93-637), as now in effect or as amended hereafter.

 

Purchaser Agreement

The purchaser agrees to all of the terms and conditions of Grid Connect’s limited warranties and the disclaimers of the limitations on Grid Connect's liability.
